ยง 4.40 Executive Order No. 40: Declaring a disaster emergency in Dutchess County [Revoked by Executive Order No. 30 (George E. Pataki), infra.]

WHEREAS, over the period May 28-31, 1984, a severe storm system resulted in flooding and caused personal hardship, extensive damage to residential and commercial properties, interruption of essential services, and disruption of vital transportation systems in Dutchess County.

NOW, THEREFORE, I, Mario M. Cuomo, Governor of the State of New York, do hereby find that a disaster has occurred within Dutchess County for which local governments are unable to respond adequately, and therefore, I hereby declare, pursuant to the authority vested in me by the Constitution, the Laws of the State of New York and section 28 of article 2-B of the Executive Law, a disaster emergency, effective May 28, 1984 within the territorial boundaries of Dutchess County.

FURTHER, pursuant to section 29 of article 2-B of the State Executive Law, I direct the implementation of the State Disaster Preparedness Plan and authorize, effective May 28, 1984, the State Emergency Management Office, the State Department of Transportation, and other State agencies as necessary, to take appropriate actions to assist Dutchess County in repairing and restoring vital transportation systems and to provide such other assistance as may be necessary to protect the public health and safety.
